Ka pasur ankesa nga operatori ekonomik “Dajti Park 2007” SHPK.Objekti i ankesës lidhet me vendimmarrjen e Komisionit të Vlerësimit të Ofertave mbi kualifikimin e ofertës së paraqitur nga operatori ekonomiki “Dion - Al” SHPK.Kjo ankese eshte publikuar ne regjistrin e ankesave më datë 09.06.2022. Komisioni i Prokurimit Publik,pas ankeses se operatorit ekonomik “Dajti Park 2007” SHPK, me ane te vendimit Nr. 933/2022 date 27.09.2022, ka vendosur: -Të pranojë ankesën e operatorit ekonomik “Dajti Park 2007” SHPK per kete procedure prokurimi. - Autoriteti kontraktor të anulojë vendimin e KVO-së për kualifikimin e operatorit. ekonomik “Dion – Al” SHPK, dhe të korrigjojë shkeljet e konstatuara , duke e skualifikuar këtë operator ekonomikë. Jane skualifikuar operatoret ekonomike te meposhtem: 1.“NIKA” SHPK per arsye: -nuk plotëson pikën 1, seksioni 2.1 “Kapaciteti profesional i operatoreve ekonomike” të Kritereve të Vecanta të Kualifikimit, pasi ne SPE ka deklaruar vetem 3 (tre) vende te ushtrimit te aktivitetit (stabilimente), te pajisura me licencat perkatese. Nderkohe qe, nga dokumentacioni i paraqitur ne SPE per kete procedure prokurimi (Kontrata nr. 3 date 05.06.2020 e lidhur ndermjet Repartit Special “DELTA” dhe OE “NIKA” shpk), rezulton se ofertuesi ushtron aktivitetin e gatimit dhe shperndarjes se ushqimit edhe prane Repartit Special per Kufirin dhe Migracionin “DELTA” me adrese Radhime Vlore, ne mbeshtetje te pikes 7.3 te kontrates, sipas te ciles” Ushqimi do te gatuhet dhe shperndahet ne ambientet e Repartit Special per Kufirin dhe Migracionin “DELTA” duke filluar nga data e lidhjes se kontrates e ne vijim…”. Bazuar ne piken 4.1 te kontrates nr. 3 date 05.06.2020 te lidhur ndermjet Repartit Special “DELTA” dhe OE “NIKA” shpk, kontrata ka hyre ne fuqi me nenshkrimin e saj nga palet me afat perfundimi deri ne date 31.12.2022. 2.“DION-AL” SHPK, per arsye: -Sipas Vendimit nr. 933/2022 date 27.09.2022 te Komisionit te Prokurimit Publik. |
